A Note Regarding Fees
Manual Processing Fee for Paper Forms:
Filing a paper form will typically incur an additional $20 manual processing fee, and forms submitted without this additional fee will be rejected.
Non-Certified Search Fee:
A $3 UCC search fee is in place for non-certified searches. Exempt users must be logged in to their account in order to avoid fees. If you require a certified search, please visit the Copy Request page.

The Office of the Secretary of State allows you to pay for services using a variety of methods. Because the fees vary with each payment method, you should review this page to understand which option will work best for you based on how you do business with the office of the Secretary of State.
Tyler Idaho Subscriber Account
Customers have the option to pay for services with their Tyler Idaho subscription. By having a subscription with Tyler Idaho, you will have the convenience of receiving a monthly invoice that details your transactions instead of being charged separately for every transaction. Tyler Idaho charges an annual subscription fee of $95. This subscription fee does not include the cost of Secretary of State services as outlined in the Fee Schedule.

EFS Subscription
The Idaho Secretary of State’s office maintains the Idaho Central Filing System, which has been certified by the USDA. When Farm Products Financing Statements (UCC-1F) are filed and recorded by our office, they become part of the Idaho Central Filing System.
One of the requirements for “Central Filing” certification by the USDA is that we maintain a “Master List” (ML) of all Farm Products Financing Statements that are filed with our office. The master list is divided into sections by category of farm product. Those sections are known as “Portions of the Master List” (PML). Each farm product category is given a “PML number” and each PML is organized alphabetically by debtor name. Each debtor entry on the PML includes all of that debtor’s information, all of the secured party (lien holder) information, and all collateral information, including collateral type, location, crop years and amounts.
A complete master list is published and distributed every two weeks as noted on the EFS Publication Schedule. The master list is published in a tab separated text file.
This master list is beneficial to buyers, commission merchants and selling agents as it provides a method to which they can be aware of persons or business entities which hold a security interest in a particular agricultural product.
Any person or business entity who wishes to receive master list information must register with the Secretary of State’s office. To subscribe to the EFS, complete the Subscriber Application/Renewal Form and return it to our office with the required payment.
The subscription fee is $60.00 per year
“Seed and Labor” List
The “Seed and Labor” List is included with the EFS subscription.
The “Seed and Labor” List consists of all current “Liens in Crops for Seed” and “Liens in Crops for Farm Labor”, as well as agricultural liens filed by the Idaho State Tax Commission. The list is published every two weeks and includes all debtor, secured party and collateral information.

State Liens
The State Liens Subscription program provides complete information to the subscribers consisting of all information provided to the Secretary of State as prescribed by Title 45, Chapter 19, Idaho Code by the Departments of Labor, Health & Welfare and the Idaho State Tax Commission, plus the lien/amendment numbers and dates assigned by our office.
Once a customer has subscribed to the program, historical files are provided that will bring them up to date with current records. Any missed downloads once historical data is provided will be charged at the rate listed below.
After the customer has received the historical data, incremental files will be available for download in daily increments. Incremental data files are then used by the subscriber to update their database.
The subscription fee is $30.00 per year.

County Medical Liens
The County Medical Liens subscription includes the information for county medical liens and any debtor information filed under the N1 form and N3 amendment form. For more on these liens see Section 45-704B, Idaho Code.
The subscription fee is $30.00 per year.

IRS/Tax Liens
The IRS/TAX subscription includes all information for active liens filed with our office by the Internal Revenue Service and the Idaho State Tax Commission. The IRS/TAX data file is available every other Wednesday, in a tab separated file.
The annual subscription fee is $120.00.
Each file download is $8.00.
Subscription payment will be required with your application and download payment will be required at the time of each download and can be charged to a credit card or to an Access Idaho Subscription Account. To subscribe to the Tax/IRS subscription, complete the Subscription Application/Renewal form and return it to our office with required payment.
UCC Data & Images
A subscription for UCC Data and Images is no longer required. To download the latest data you need to log onto our website and select Data Requests from the left hand side. From there, you will be able to select the desired file to download.
Data
UCC and lien data is made available for download, in bulk, on a bi-weekly basis – every other Monday. The raw data extracted from the IDSOS UCC/Liens database consists of all UCC and lien filings of all statuses and is offered in a tab-delimited format. The data tables will have to be reconstructed by the recipient. Each extract is a full replacement of all data, which includes UCC, lien, debtor, secured party, amendment and amendment-action information. Collateral information is not included.

Images
UCC and lien document images are made available for download on a bi-weekly basis – every other Monday. Due to the sheer size of our image database, these extracts only include document images created since the previous extract. Images relating to UCC, lien, and amendment filings are included. Image files are in TIF and PDF.

UCC FAQ
What is a lien?
A lien is defined as an interest or encumbrance held by a creditor against a debtor’s real or personal property for the satisfaction of a debt.
The lien most people are familiar with is known as a mechanics lien. A mechanics lien is defined as the legal enforceable claim which a person who has performed work or provided materials is permitted to make against title to the property or as a preferential person in the event the estate or business is liquidated.
This type of lien is filed in the county clerk’s office for the county in which the property resides.
What role does the Secretary of State play in the filing of liens?
The Secretary of State’s UCC (Uniform Commercial Code) Division is the agency which receives and files liens and UCC Financing Statements, thereby making the liens public record, as well as providing a date and time of the filing. The UCC division also maintains a searchable database of lien filings for future reference, as necessary.
Can I file a lien against myself?
No. A debtor and a secured party may not appear to be the same individual.

What is a transmitting utility?
A transmitting utility is a person primarily engaged in the business of operating a railroad, subway, street railway, or trolley bus, or transmitting communications electrically, electromagnetically, or by light or transmitting goods by pipeline or sewer, or transmitting or producing and transmitting electricity, steam, gas or water.

If a filing indicates that the debtor is a transmitting utility we may require reasonable proof that an individual debtor is in fact a “transmitting utility” as defined above.

What is a debtor?
A debtor is a person who owes a creditor; someone who has the obligation of paying a debt.
What is a secured party?
A secured party is a person or organization that is lending money.
What other kinds of liens are there?
The various liens that are filed with the Secretary of State’s office are:
- Financing Statement, using form UCC1 or by using the online filing application – This financing statement is used as an agreement between a lender (secured party) and a borrower (debtor), with the borrower using collateral for a loan. Amendments (changes) to this type of lien may be filed using form UCC3.
- Commodity lien, using form C1 – An individual may file this against a company to require payment for materials provided. Generally used by animal feed suppliers.
- Farm Products Financing Statement, using form UCC1F – A farmer (debtor) may use a future crop or sale of livestock as collateral with a creditor (secured party) to receive a loan for operating expenses. Amendments (changes) may be filed using form UCC3F.
- IRS lien, using form 668 – The IRS files this lien against businesses or agriculture for unpaid taxes – may also be filed against the business owner.
- Labor lien, using form SL1 – A lien filed against a farmer by an individual or business that provides services to the farmer such as harvesting, planting or picking – only applies to planted crops.
- Medical lien, using form N1 – When medical services are provided to a person who has little or no ability to pay, the county of residence will pay the medical service provider. The county will then file this lien to require future repayment by the individual who received the medical services. Amendments (changes) to this type of lien may be filed using form N3.
- Seed lien, using form SL1 – This lien is used between a farmer and a seed provider. A provider supplies a farmer with seed to plant a crop and that future crop is used as collateral for the seed. The seed provider must be repaid upon harvest, before any other payment is made, or profit is realized. Amendments (changes) to this type of lien may be filed using form S3.
- Utility lien, using form UCC1 – This lien is used as an agreement between a utility provider (gas, electric, cable, etc…) and a lender (secured party) to ensure repayment of a loan. This type of lien never expires.

Can I file online?
At this time only UCC1 financing statements and UCC3 financing statement amendments may be filed online. You may not include attachments with online filings. If you need your filing to include an attachment you will have to file by mailing the form and other documents along with payment directly to our office.

What do the letters at the beginning of a filing number mean?
- B – UCC Financing Statement (UCC-1) or amendment
- F – Farm Products Financing Statement (UCC-1F) or amendment
- T – Idaho State Lien filed by one of three Idaho agencies
- N – Medical Indigency Lien filed by county agencies
- I – IRS Lien
- S – Seed Lien
- L – Farm Labor Lien
- C – Agricultural Commodity Lien

An Idaho state tax lien appeared on my credit report. What do I do?
The three credit reporting agencies, Equifax, Experian, and TransUnion, display liens from three different Idaho agencies under the heading “state tax lien”. The three agencies are:
Idaho Department of Labor – This agency generally files liens to recover over-payment of unemployment benefits, or to recover unemployment insurance taxes not paid. They can be contacted at: 208-334-6387 or 800-448-2977.
Idaho Department of Health and Welfare – This agency generally files liens to recover unpaid child support, to recover Medicaid, or for estate recovery of permanently institutionalized people. Contacts:

Idaho State Tax Commission – This agency generally files liens to recover unpaid state income tax. They can be reached at: 208-334-7716
If the lien has been satisfied (paid in full), and released, one may contact the UCC Division and request a copy of the release filing.
Most records stay on a credit report for seven years, while some remain for ten years. The Consumer Financial Protection Bureau has some helpful tips to assist in correcting a credit report.

Why do only some lien files have any dollar amounts?
Is there any additional information available on a state lien filed with the Secretary of State?
How are files formatted?

Why does my Access database have problems importing the data into my database?
Is there any way short of actually looking at the file header record to differentiate new lien files from Amendment files? Perhaps by the naming convention?
The only indication of the type of file is located inside the files themselves. The header record should contain one of four letters in position 24 to indicate the type of file:
- O — Original Filings file
- A — Amendment files
- Z — Only used in conversion files, these were historical amendments
- C — Only used in conversion files, these were historical original filings
What values would we expect to see in the D-Name-Suffix field?
Will any AKA or DBA records be reported on the files or will the reporting be limited to the primary individual or business name? If the AKA and DBA will be reported, how will I be able to distinguish them from the primary record?
Does the history file that you’ve sent represent all of the liens and releases that were formerly filed in the counties?
